Mintu SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to bail in the case under Section 30(a) of the Bihar Prohibition and Excise Act.

Summary

Mintu Singh was charged under Section 30(a) of the Bihar Prohibition and Excise Act for alleged recovery of 656.610 litres of liquor from a bush. The petitioner argued that he was not arrested at the spot, no liquor was found in his possession, and the recovery occurred on public land, with the case being mechanically built on a chowkidar's statement without proper investigation. He also disclosed seven prior cases, five under the Excise Act, and had been in custody since 12 January 2026. The State opposed bail, citing his antecedents. The Court, noting the lack of direct seizure, the public nature of the alleged site, and the procedural deficiencies, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, to be satisfied by the trial court.
