Patna High Court

Binda Rai @ Binda Gope @ Binda Gop @ Vinda RayversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The petition for bail is dismissed; the petitioner is not entitled to bail.

Summary

The petitioner, Binda Rai, was charged under several serious provisions of the Indian Penal Code, including sections 341, 342, 323, 324, 307, 504, 506 and 302/34. He previously applied for regular bail in Criminal Miscellaneous No. 29206 of 2025, which the Patna High Court rejected on 6 August 2025. The present application is his second attempt to obtain bail for the same case (Session Trial No. 11 of 2019 arising out of Raghopur PS). The Court examined the earlier order and found no new material or change in circumstances that would justify granting bail. Consequently, the Court upheld its earlier view and denied the bail petition. The order was pronounced by Justice Satyavrat Verma.

Issues considered

  • Whether the petitioner is entitled to bail for offences punishable under Sections 341, 342, 323, 324, 307, 504, 506 and 302/34 of the IPC, considering the earlier denial of bail.
