The revision petition is disposed, and the maintenance order is modified to Rs 5,000 per month as per the parties’ settlement.

Summary

The petitioner sought revision of a family court order directing him to pay Rs 7,000 per month as maintenance to the respondent. Both parties presented an amicable settlement whereby the petitioner would pay Rs 5,000 per month in five equal installments, starting the first week of May 2026. The court, noting the settlement, modified the earlier maintenance order to reflect the agreed amount without examining the merits of the case. It ordered the petitioner to pay Rs 5,000 monthly into the respondent’s account and disposed of the revision petition. Both parties were left free to seek execution of the modified order, and the order was to be communicated to the lower family court.

Issues considered

  • Whether a revision petition can be disposed of on the basis of an amicable settlement between the parties.
  • Whether the family court's maintenance order can be modified to reflect the parties' agreed amount without a merits hearing.
