DISPOSED

Holding

The Court directed the jail superintendent to forward the petitioner's proposal and reports to the State Sentence Remission Board and mandated the Board to decide on premature release within stipulated time.

Summary

Muslim Miyan was convicted under Sections 302/34, 307/34 of the IPC, Section 27 of the Arms Act and Sections 3 and 4 of the Explosive Substances Act and sentenced to life imprisonment with several terms of rigorous imprisonment. After serving more than 14 years in actual custody and over 20 years including remission, he filed a writ petition seeking a mandamus directing the jail superintendent to forward his proposal and relevant reports to the State Sentence Remission Board for premature release. The petitioner argued that he had fulfilled the required period of incarceration and was covered under Notification No. 3106 (2002) policy. The High Court examined whether the authorities were obliged to refer the case to the Remission Board and whether premature release could be granted under the remission policy. The Court ordered the jail superintendent to place the matter before the Board within six weeks and directed the Board to decide within the next six weeks. The writ petition was thereafter disposed.

Issues considered

  • Whether the petitioner is eligible for premature release under the State Sentence Remission Board policy after serving the prescribed period of imprisonment and remission.
  • Whether the jail authorities are mandated to forward the petitioner's proposal and requisite reports to the State Sentence Remission Board.
