The writ petition is not maintainable; the petitioner must seek relief under Section 127 CrPC and Section 146 B.N.S.S., 2023 before the Family Court.

Summary

Petitioner Mamta Devi, who was not receiving maintenance from her husband after his retirement as a teacher, approached the Patna High Court seeking a direction to deduct maintenance from his pension. The Family Court had earlier ordered maintenance to be deducted from his salary, but the pension authorities could not effect the deduction. The petitioner invoked Section 127 of the Code of Criminal Procedure, 1973 and the corresponding Section 146 of the B.N.S.S., 2023 for alteration of allowances. The Court held that the petitioner has a statutory remedy under these provisions and that the writ petition is not maintainable. Consequently, the petition was dismissed, with liberty granted to the petitioner to approach the Family Court for modification of the earlier order.

Issues considered

  • Whether a writ petition under Article 226 can be entertained to direct deduction of maintenance from a pensioner's benefits.
  • Whether the petitioner must pursue the remedy available under Section 127 of the CrPC and Section 146 of B.N.S.S., 2023 for alteration of allowances.
