The court granted liberty to the petitioner to file a petition under Rule 12A before the Collector and disposed of the writ petition.

Summary

Chandani, wife of Manoj Yadav, filed a writ petition seeking release of her motorcycle seized under Section 317(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition & Excise Act, 2016 in a case against her husband and Vishal Gupta. She requested liberty to file a petition under Rule 12A of the Bihar Prohibition and Excise (Amendment) Rules, 2023 for release of the vehicle on payment of a penalty. The State had no objection to this request. The High Court held that it was appropriate to grant her liberty to file the Rule 12A petition before the Collector of Gopalganj within three weeks, and directed the Collector to decide the petition on merit within four weeks. Consequently, the writ petition was disposed.

Issues considered
