Summary

The petitioner, Kumod Kumar, filed a writ petition seeking the release of his seized motorcycle, which was confiscated in connection with a case involving 30 litres of illicit country-made liquor. The seizure was made under Sections 274, 275, 317(5), 3(5) of the Bihar Narcotic Substances Act, 2023 and Section 30(a) of the Bihar Prohibition & Excise Act, 2016. The petitioner’s counsel requested liberty to file a petition under Rule 12A of the Bihar Prohibition and Excise (Amendment) Rules, 2023 for release of the vehicle upon payment of a penalty. The State had no objection to this request. The Court held that, given the facts, it was appropriate to grant the petitioner liberty to file such a petition within three weeks, and directed the District Magistrate to decide the matter on merit within four weeks. Consequently, the writ petition was disposed of.

Issues considered

  • Whether the petitioner is entitled to liberty to file a petition under Rule 12A of the Bihar Prohibition and Excise (Amendment) Rules, 2023 for the release of the seized motorcycle.
