Holding

The Court grants liberty to file a revision petition under Section 93 and orders the writ petition disposed.

Summary

The petitioner, Anil Kumar Singh, filed a writ petition challenging two orders: one by the Collector cum District Magistrate, Kaimur, confiscating his vehicle, and another by the Excise Commissioner, Bihar. The petitioner sought liberty to file a revision petition under Section 93 of the Bihar Prohibition and Excise Act, 2016, contesting the orders and the requirement to release the vehicle upon payment of a penalty under Rule 12‑A of the Bihar Prohibition and Excise (Amendment) Act, 2023. The Court, after hearing counsel, granted the requested liberty, directing that a revision petition be filed within two weeks and that the revisional authority decide the penalty issue within four weeks. The Court emphasized the need for a reasoned speaking order from the revisional authority. Consequently, the writ petition was disposed of.

Issues considered

  • Whether the petitioner is entitled to file a revision petition under Section 93 of the Bihar Prohibition and Excise Act, 2016 against the orders of the Collector and the Excise Commissioner.
  • Whether the vehicle confiscated in the excise case must be released upon payment of the penalty as per Rule 12‑A of the Bihar Prohibition and Excise (Amendment) Act, 2023.
