The writ petition is dismissed as infructuous because the tender has been withdrawn/annulled by the authority, eliminating the petitioner’s grievance.
Summary
Butterfly India, a proprietorship firm, filed a writ petition challenging the Bihar Education Project Council’s (BEPC) tender for exclusive supply of sports kits, alleging that several tender clauses were arbitrary, whimsical, and discriminatory, violating Articles 14, 19 and 301 of the Constitution. The petitioner sought quashing of the tender, a declaration of lack of transparency, modification of the tender conditions, and a stay of further proceedings. The respondents argued that they intended to withdraw the tender under clause 3.4 of the NIT, which authorises the authority to annul the bidding process at its discretion without assigning reasons. The Court observed that the petitioner’s grievance no longer existed because the tender was to be withdrawn, rendering the petition infructuous. Consequently, the Court disposed of the writ petition as infructuous and vacated the interim relief previously granted. No further orders were deemed necessary.
Issues considered
- Whether the petition for quashing the BEPC sports‑kit tender remains maintainable after the authority’s intention to withdraw the tender under clause 3.4.
- Whether the tender clauses alleged to be arbitrary and discriminatory violate Articles 14, 19 and 301 of the Constitution.
