Holding

Since part of the claim has already been satisfied and no further direction is required, the writ application is disposed of.

Summary

Ms. Chanchal Kumari, the widow of a deceased Sashastra Seema Bal employee, filed a writ petition seeking the quashing of letters that delayed her family pension, terminal dues, and accidental insurance benefits. She alleged that the State Bank of India branches unjustifiably refused to process her applications, citing nominee issues and her residential address. The petitioner claimed she had complied with all procedural requirements and requested payment of all entitlements into her SBI Pandaul account. The court noted that, pursuant to the judgment in Smt. Bolla Malathi v. B. Suguna (Civil Appeal No.14604 of 2025), half of the insurance amount had already been paid to her. Considering that part of the claim was satisfied and no further direction was necessary, the court found no basis to issue additional orders. Consequently, the writ application was disposed of.

Issues considered

  • Whether the respondents' refusal to process the petitioner's claim for family pension, terminal dues, and accidental insurance amounts to an illegal denial of her statutory entitlements
  • Whether the writ petition should be entertained to direct payment of the pending amounts

Subjects

  • family pension
  • terminal dues
