Holding
The Court held that the petitioner must first file a fresh representation with supporting appointment documents, after which the claim will be adjudicated and appropriate orders may be passed.
Summary
The petitioner, Shashinath Choudhary, filed a writ petition seeking payment of salary arrears, gradation pay and enhancement for his service as a Lecturer in Maithili at Ram Lakhan Singh Ramswaroop Mandal College. The University objected, stating that the petition lacked details of his appointment and the period for which salary was claimed. The Court directed the petitioner to submit a fresh representation before the Registrar, furnishing his appointment letter and salary particulars to substantiate his claim. The Court further ordered that, if the claim is found justified after verification, the arrears and related benefits be granted within two months of receipt of the representation. Consequently, the writ application was disposed of pending the petitioner’s compliance with the directions.
Issues considered
- Whether the petitioner is entitled to arrears of salary, gradation pay and enhancement for his tenure as Lecturer.
- Whether the lack of appointment details in the petition precludes the Court from granting relief.
- Whether the Court can direct the University to verify the petitioner’s claim before granting the salary arrears.
