The court held that the bank may retain only the disputed amount of Rs. 54,000 while ordering the release of the remaining pensionary benefits within two weeks, and disposed of the writ petition.
Summary
Kapildeo Kumar Verma, a retired employee of Uttar Bihar Gramin Bank, challenged the bank's decision to place his pension payment order on hold following an allegation that he released a pledged Kisan Vikas Patra (KVP) belonging to a customer. The petitioner contended that he was not posted at the branch on the date of the alleged release, rendering the allegation false and the hold beyond the bank's jurisdiction. The bank argued that the petitioner had not responded to the charge sheet annexed to the petition and therefore justified the hold of Rs. 54,000. The High Court directed the bank to release the undisputed portion of the pension within two weeks while retaining only the disputed Rs. 54,000 pending further adjudication. The court ordered that appropriate proceedings be conducted regarding the disputed amount and disposed of the writ petition.
Issues considered
- The bank's jurisdiction to withhold a pension payment order on the basis of alleged loan default
- Whether the petitioner’s alleged non‑posting at the time of the alleged KVP release negates liability
- Procedural requirement for the petitioner to respond to the charge sheet before pension can be withheld
- The proportionality of withholding the entire pension for a disputed amount of Rs. 54,000
Subjects
- pension
- pension payment order
- bank jurisdiction
- loan default
- Kisan Vikas Patra
- civil writ jurisdiction
- proportionality
- disputed amount
