The District Magistrate must decide the petitioner’s application for an arms licence within eight weeks and communicate the order.

Summary

The petitioner, Md. Arif Sakir, filed a writ petition seeking a direction to the State of Bihar and its officials to grant him an arms licence for a handgun. He had already submitted an application in the prescribed format to the District Magistrate, Patna on 10‑11‑2023, but no decision had been taken. The petitioner argued that the delay violated the provisions of the Arms Act which allow a licence to be granted for safety of life and property. The State contended that the application was pending adjudication and the competent authority must pass an order in accordance with law. The High Court directed the District Magistrate to take a final decision on the licence application within eight weeks and to communicate the order to the petitioner, thereby disposing of the writ application.

Issues considered

  • Whether the District Magistrate is obligated to decide the pending arms licence application within a reasonable time.
  • Whether the High Court can direct the competent authority to pass an order on the licence application.
