Summary

The petitioner, Manjay Kumar, filed a writ petition seeking the release of his red TVS motorcycle seized under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 after 50 litres of illicit country‑made liquor were recovered from it. He requested liberty to file an application under Rule 12A of the Bihar Prohibition and Excise (Amendment) Rules, 2023 for release upon payment of a penalty. The State of Bihar raised no objection to such an application. The High Court granted the petitioner liberty to file the Rule 12A application within three weeks and directed the competent authority to decide the application on merits and issue a reasoned order within four weeks. The writ petition was consequently disposed of on these terms.
