Holding
The Court directed the petitioner to file a detailed representation within a week and the Board to adjudicate the objections within two weeks, thereby disposing of the writ application.
Summary
The petitioner, Nitish Kumar Chaubey, filed a writ petition seeking a mandamus directing the Bihar School Examination Board (BSEB) to consider his objection form and rectify alleged anomalies in the evaluation of the 2025 Secondary Teacher Eligibility Test (STET). He claimed that despite providing authoritative answers, he received only 76 marks and that his objections on three questions were not adjudicated, nor was the normalization process under advertisement PR 218/2025 applied. The BSEB argued that the petitioner should file a detailed representation and that experts were already engaged to examine the objections. The Court, after hearing both sides, ordered the petitioner to submit a comprehensive representation within one week, referencing his earlier filing, and directed the Board to decide the matter within two weeks of receipt. The writ application was consequently disposed of.
Issues considered
- Whether the Bihar School Examination Board is duty-bound to consider the petitioner's objection form and rectify alleged evaluation anomalies in the STET 2025.
- Whether the petitioner is entitled to a writ of mandamus directing the Board to issue a revised answer key.
- Whether the Board must apply the normalization procedure as stipulated in advertisement PR 218/2025.
