The Court granted liberty to file a revision petition within two weeks and stayed the auction of the vehicle pending the revision.

Summary

The petitioner, Musheer Miyan, filed a writ petition challenging a confiscation order and a subsequent appellate order under the Bihar Prohibition and Excise Act, 2016. The petitioner sought liberty to file a revision petition under Section 93 of the Act against the appellate order. The Court granted the liberty, directing that a revision petition be filed within two weeks and that the revisional authority decide the matter on merits without limitation issues, delivering a reasoned order within four weeks. The Court also ordered that the petitioner's vehicle not be auctioned until the revision petition is disposed of, provided it is filed within the stipulated period. Accordingly, the writ petition was disposed of on these terms.
