Dr. Mohammed KamalversusThe State of Bihar

DISPOSED

Holding

The Court directed the petitioner to appear before the Registrar with required documents for PRAN ID generation and expected the Registrar to order payment of salary and arrears, thereby disposing of the writ petition.

Summary

The petitioner, Dr. Mohammed Kamal, filed a writ petition seeking to quash a letter dated 12 March 2025 that stopped his salary because he had not opted for a new pension scheme and had not generated a PRAN ID. He also sought protection from any disciplinary or vindictive action and requested that his service be treated as continuous for purposes of salary. The respondents, Purnea University and the State of Bihar, contended that the salary could not be released until the petitioner complied with the formalities for generating a PRAN ID as required by the Department of Education. The Court examined whether the Registrar's refusal to pay salary was lawful and whether the petitioner could be compelled to cooperate. It held that the petitioner must appear before the Registrar with the necessary documents to facilitate PRAN ID generation, after which the Registrar should order payment of the current salary and arrears. Accordingly, the writ petition was disposed of with directions for compliance.

Issues considered

  • Whether the Registrar's order refusing salary payment for non‑compliance with pension scheme requirements is legally valid.
  • Whether the petitioner can be compelled to cooperate in generating a PRAN ID as a condition for salary release.
  • Whether the writ petition seeking quash of the salary‑stopping order and protection from disciplinary action should be entertained.

Subjects

  • salary stoppage
  • pension scheme
  • PRAN ID
  • university employment
  • writ of certiorari
  • disciplinary action
  • service continuity
