The court granted liberty to the petitioner to file a petition under Rule 12A of the Rules, 2023 and disposed of the writ petition on that basis.
Summary
The petitioner, Anuj Sharma, filed a writ petition seeking the release of his seized Hero Splendor+ motorcycle, which was confiscated under the Bihar Prohibition and Excise Act, 2016 for alleged involvement in an illicit liquor case. He requested liberty to file a petition under Rule 12A of the Bihar Prohibition and Excise (Amendment) Rules, 2023, seeking release of the vehicle upon payment of a penalty. The State of Bihar raised no objection to this request. The High Court, after considering the facts, granted the petitioner liberty to file the Rule 12A petition within four weeks before the Collector‑cum‑District Magistrate and directed that the petition, if filed, be decided on its merits within another four weeks. Consequently, the writ petition was disposed of on these terms.
