Amrendra PrasadversusThe State of Bihar

Holding

The court held that because the Jamabandi is already computerized, the petitioner must seek rectification under the applicable land‑record law and no mandamus is warranted.

Summary

The petitioners, including Amrendra Prasad, filed a writ petition seeking a mandamus directing the land revenue authorities to include a left‑out parcel of land (Khata No. 95, Kheshra No. 473) in Jamabandi No. 8, which is in the name of the late Ram Narayan Prasad. They also asked for a show‑cause order as to why the land had been omitted. The State, through its counsel, informed the court that Jamabandi No. 8 has already been computerized as Computerized Jamabandi No. 213104400101264 in favour of the deceased and that any correction, if required, can be sought by the petitioner through the prescribed rectification procedure. The court examined whether a writ of mandamus was appropriate when the record is already computerized and the remedy of rectification is available. Finding no merit in issuing a mandamus or a show‑cause notice, the court disposed of the petition, directing the petitioner to approach the authorities for rectification if needed.

Issues considered

  • What relief, if any, is appropriate when a land parcel is omitted from a computerized Jamabandi?
  • Whether the court should issue a writ of mandamus directing inclusion of the left‑out land in the Jamabandi?
