The vehicle could not be seized as no offence under the Bihar Prohibition and Excise Act, 2016 was made out, and it must be released.

Summary

The petitioner sought the release of his XUV-500 vehicle seized during a raid on a garage where illicit liquor was recovered from another truck. The police report confirmed that no liquor was found in the petitioner's vehicle. The petitioner argued that, without any contraband, the vehicle could not be seized under the Bihar Prohibition and Excise Act, 2016. The State conceded that no liquor was recovered but did not contest the legal point. The Court held that the provisions of the Act are not triggered when no offence is established, and therefore the seizure was unlawful. Consequently, the Court directed the authorities to release the vehicle within a week upon proof of ownership, and the writ petition was allowed.

Issues considered

  • Whether a vehicle can be lawfully seized under Section 30(a)/32(2)(3) of the Bihar Prohibition and Excise Act, 2016 when no illicit liquor is found in it
