The District Magistrate must decide the pending arms licence application within eight weeks and communicate the order to the petitioner.

Summary

The petitioner, Abhishek Kumar Tiwari, filed a writ petition seeking a direction to the State of Bihar and its officials to grant an arms licence that he had applied for eight years earlier. He alleged that despite filing the application in the prescribed format before the Siwan District Magistrate, no decision had been taken. The State contended that the application was pending and the competent authority was required to adjudicate it. The Court observed that the authorities must act on the pending application and directed the District Magistrate to pass a final order on the licence within eight weeks and communicate the decision to the petitioner. Accordingly, the writ application was disposed with the said direction.

Issues considered

  • Whether the District Magistrate is obligated to decide a pending arms licence application within a reasonable time.

property upon an application being made. Despite the
