The court directed the District Land Acquisition Officer to determine compensation based on the Minimum Value Register and to dispose of the petitioners’ application, or alternatively authorise the District Magistrate to act.
Summary
The petitioners, three brothers claiming ancestral ownership of land in Mauja‑Barwa, Khata No‑213, alleged that the State of Bihar and its officials had encroached upon their property. They filed a writ petition seeking mandamus directing the respondents to pay compensation under the Land Acquisition Act, remove the encroachment, and pass a compensation award based on the Minimum Value Register. The District Magistrate had earlier ordered the District Land Acquisition Officer to conduct a hearing, but the officer failed to act on the petitioners’ application. The High Court examined whether the officer’s inaction warranted judicial intervention and whether the petitioners were entitled to compensation and removal of the encroachment. The Court directed the Land Acquisition Officer to determine compensation using the MVR and to dispose of the application, alternatively empowering the District Magistrate to act if title was undisputed. Consequently, the petition was disposed of.
Issues considered
- Whether the District Land Acquisition Officer’s failure to act despite a magistrate’s direction justifies court intervention.
- Whether the petitioners are entitled to compensation and removal of encroachment under the Land Acquisition Act.
- Whether the court can direct the determination of compensation based on the Minimum Value Register.
