Md. TahsinversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The Court directed the petitioner to file a detailed representation within one week and the Board to adjudicate the representation within two weeks, thereby disposing of the writ application.

Summary

The petitioner, Md. Tahsin, filed a writ petition seeking a mandamus directing the Bihar School Examination Board (BSEB) to consider his objection form filed through the official portal for the Secondary Teacher Eligibility Test (STET) 2025 and to issue a revised answer key. He alleged that despite providing authoritative answers, he received only 65 marks and that his objections on 12 questions were not adjudicated, nor was the principle of normalization invoked as per advertisement PR 218/2025. The Board contended that the petitioner should first file a detailed representation, after which the already‑engaged experts would adjudicate the objections. The Court held that the matter should not remain pending and ordered the petitioner to file a comprehensive representation within one week, incorporating any normalization issues, and directed the Board to decide the representation within two weeks. Accordingly, the writ application was disposed of without granting a mandamus. The decision emphasizes procedural compliance before judicial intervention in examination disputes.

Issues considered

  • Whether the BSEB is legally bound to consider the petitioner’s objection form and issue a revised answer key for STET 2025.
  • Whether the petitioner is entitled to a writ of mandamus directing the Board to adjudicate the objections and apply normalization as per advertisement PR 218/2025.
  • Whether the court can compel the petitioner to file a detailed representation and set timelines for the Board’s adjudication.

spite this petitioner having given authoritative answers to the

have already been provided still, such objections have not been

          adjudicated.
