Patna High Court

Prashant RajakversusThe Union of India

Decided
Disposal
DISPOSED

Holding

The Court held that the petitioner must approach the UIDAI Regional Office for correction, and therefore the writ petition was disposed without a court‑directed amendment.

Summary

Petitioner Prashant Rajak filed a writ petition seeking correction of his date of birth on his Aadhaar card from 24-07-2008 to 24-07-2007, citing his matriculation certificate. He alleged that his earlier application to UIDAI was not considered. The Union of India, represented by UIDAI officials, contended that the petitioner could appear before the Director of the UIDAI Regional Office, Patna, and that correction would be made upon production of the required statutory documents. The Court observed that many similar cases burden the judiciary and emphasized that the statutory correction procedure should be followed. Accordingly, the Court directed the petitioner to approach the UIDAI Regional Office within one week for the correction and disposed of the writ petition.

Issues considered

  • Whether the court can directly order correction of the date of birth in the Aadhaar database.
  • Whether the petitioner must first approach UIDAI and comply with statutory documentary requirements for correction.

Subjects

  • Aadhaar
  • date of birth correction
  • UIDAI
  • writ petition
  • administrative procedure

2 16-03-2026 In the instant petition, petitioner has prayed for the

                   following relief(s):-

                                2. Counsel for the petitioner submits that the correct

date of birth of the petitioner is 24.07.2007, but in the Aadhar

database, it has been wrongly recorded as 24.07.2008, and the

petitioner is said to have made an application before the

authorities, but for reasons unexplained, the same has not been

          considered.

                      3. On the other hand, counsel for the Union of India

submits that the petitioner with representation may appear

before the Director, UIDAI Regional Office, 4th Floor, Lalit

Bhawan, Bailey Road, Patna, on any working day, and the

necessary correction in the Aadhar database shall be made by

looking to the statutory documents, which are required for

          necessary corrections.

                      4. It is a very sorry state of affairs, which this Court

has witnessed today, that in so many cases, for correction of date

of birth, the applicants are forced to knock the doors of this

Court. It is expected that the Director, UIDAI Regional Office,

Patna, would issue appropriate instruction to the persons who

are dealing with such issues, so that this Court is unnecessary

not burdened with such petitions where, for correction of date of

birth, the statutory requirement of documents are already being

fulfilled and the persons who are at the helm of affairs are to

carry out the formalities, and accordingly, the necessary

corrections are required to be made in the Aadhar database,

which somewhere is not being addressed properly.

                                 5. Considering the nature of relief sought, this Court

finds it appropriate to direct this petitioner to approach the

Director, UIDAI Regional Office, Patna, within a period of one

week, and on his appearance it is expected that necessary

corrections shall be made looking to the nature of the document,

which is required for making such corrections.

                                 6. With the above observations, the instant writ

                     petition stands disposed of.
