The court directed the District Magistrate‑cum‑Collector to examine the revenue records and lease agreement to determine the petitioners' entitlement to higher compensation and disposed of the writ petition.

Summary

The petitioners, heirs of a deceased landowner, filed a writ petition seeking a mandamus directing the State to set aside a letter that allegedly misreported the Minimum Valuation Report (MVR) for land acquisition for a road widening project, and to award compensation calculated at twice the residential rate as per the Bihar Private Land Lease Policy, 2014. They contended that they had deposited the requisite amount based on the MVR and that the District Magistrate‑cum‑Collector is the competent authority to consider their grievance. The court examined the petition and observed that the petitioners had already approached the District Magistrate for relief. It directed the District Magistrate to promptly call for the relevant revenue records and the lease agreement dated 18‑09‑2024, and to determine whether the petitioners are entitled to a higher compensation based on the prevailing MVR. The court further warned that if the revenue authority fails to act, the petitioners may pursue further legal action. With these directions, the writ petition was disposed of.

Issues considered

  • Whether the respondents wrongly reported the Minimum Valuation Report (MVR) for the land acquisition.
  • Whether the petitioners are entitled to compensation at twice the residential land rate under the Bihar Private Land Lease Policy, 2014.
  • Whether the District Magistrate‑cum‑Collector is the appropriate authority to examine and decide the petitioners' claim.
