Holding
The Court disposed of the writ petition, directing the petitioners to approach the District Magistrate to have the pending encroachment proceeding concluded under the Bihar Public Land Encroachment Act, 1956.
Summary
The petitioners, a large group of landowners, filed a writ petition against the State of Bihar and several officials seeking the removal of alleged encroachments on plots recorded as Anaband Sarv Sadharan land in Khata No. 147. They invoked the Bihar Public Land Encroachment Act, 1956, requesting a mandamus directing the Sub‑Divisional Officer to vacate, demolish and restore possession of the encroached land, and cited a prior High Court order (CWJC No 9692 of 2015). The State contended that notices under Section 3 of the Act had already been issued and that the administrative proceedings should be allowed to run to completion with a fixed timeline. The Court examined the submissions and held that the appropriate remedy was for the petitioners to file a representation before the District Magistrate, who can direct the concerned authority to conclude the encroachment proceeding in accordance with the Act and revenue records. Accordingly, the writ petition was disposed of without granting the specific mandamus reliefs.
Issues considered
- Whether the High Court can issue a writ of mandamus directing immediate removal of encroachment when administrative proceedings under the Bihar Public Land Encroachment Act are already underway.
- Whether the petitioners should be directed to approach the District Magistrate to have the pending encroachment case concluded under the statutory procedure.
