Holding

The court held that the municipal corporation and the State must pay the petitioner's retirement benefits with interest and disposed the petition accordingly.

Summary

The petitioner, a former sweeper of Samastipur Municipal Corporation, filed a writ petition seeking a mandamus directing the State of Bihar and the municipal corporation to pay all his retirement benefits, including provident fund, gratuity, leave encashment, and GIC, with interest, based on revised pay scales. The corporation contended that records were missing and no final order on pensionary benefits had been passed. The petitioner relied on earlier orders of a coordinate bench directing payment of retiral dues with 9% interest per annum. The respondents sought to examine the petitioner's case in light of two earlier writs (C.W.J.C. No.10632 of 2019 and C.W.J.C. No.10633 of 2019) involving similar claimants. The court noted that any amounts already released should be reflected in the final order and directed the executive officer to determine the dues. Consequently, the writ petition was disposed, with the respondents ordered to settle the petitioner’s retirement benefits with interest.

Issues considered

  • Whether the respondents are liable to pay the petitioner's retirement benefits under the revised fifth and sixth pay scales.
  • Whether a writ of mandamus can be issued directing payment of such benefits with interest.
  • Whether the petition can be disposed of based on earlier similar orders of the court.

Subjects

  • retirement benefits
  • writ of mandamus
  • municipal corporation
  • public service pension
  • interest on dues
  • revised pay scale
