Holding
The petition is disposed without granting the writ, directing the respondents to examine the case and pass appropriate orders within eight weeks.
Summary
The petitioner, a former attendant of the Samastipur Nagar Parishad now under the Municipal Corporation, filed a writ petition seeking a mandamus directing the State of Bihar and the Municipal Corporation to pay all his retiral benefits, including provident fund, gratuity, leave encashment, and GIC, with interest, based on revised pay scales. The respondents argued that the service records were missing and therefore the pensionary benefits could not be released. The petitioner relied on earlier decisions of a coordinate bench of the Patna High Court that had ordered payment of similar dues with interest at 9% per annum. The court examined the submissions and referred to two earlier writs, C.W.J.C. No.10632 of 2019 and C.W.J.C. No.10633 of 2019, involving Ram Sevak Paswan and Lalan Prasad Singh, respectively. The court directed the respondents to examine the petitioner's case in light of those precedents and to pass any necessary order within eight weeks, but ultimately disposed of the writ petition without granting the relief sought. The order emphasizes that any amounts already paid should be reflected in the final order.
Issues considered
- Whether the respondents are liable to pay the petitioner's retiral benefits, including provident fund, gratuity, leave encashment, and GIC, with interest as per revised pay scales.
- Whether a writ of mandamus can be issued directing the payment of such retiral benefits.
- Whether the petition should be dismissed in view of similar orders in earlier writ petitions.
