Holding

The court ordered the petitioner to file a fresh representation and directed the authority to decide it within six weeks, thereby disposing of the writ petition.

Summary

Kamlesh Upadhyay, a block teacher, filed a writ petition seeking a mandamus directing the Director of Primary Education to expedite and decide his pending representation regarding the grant of matric‑trained pay‑scale and related benefits, as ordered in the earlier Kishor Kumar case. The petitioner alleged that despite a directive for a four‑week decision, the representation filed on 06‑03‑2023 remained unresolved. The State argued that the pending representation could be dealt with by the authority. The High Court directed the petitioner to file a fresh representation within two weeks, referencing the earlier representation and court order, and instructed the authority to decide it within six weeks and grant any entitled benefits. The court then disposed of the writ petition.

Issues considered

  • Whether the court can issue a mandamus directing the Director, Primary Education to decide the pending representation.
  • Whether the petitioner is entitled to relief for delay in adjudicating his representation under the earlier judgment.

the grant matric trained pay-scale with effect from the date of

completion of training along with all consequential monetary

benefits and despite appropriate representation having been filed
