The petition was disposed of without granting the writ of mandamus, pending further examination of the case in light of similar precedents.
Summary
The petitioner, a former Junior Engineer of Nagar Parishad Samastipur, filed a writ petition seeking a mandamus directing the State of Bihar and the Samastipur Municipal Corporation to pay his retiral benefits, including provident fund, gratuity, leave encashment, and pension arrears with interest, effective from 31/10/2018. The respondents argued that the relevant service records were missing and therefore the pension benefits could not be released. The court noted that similar writ petitions (C.W.J.C. No.10632 of 2019 and C.W.J.C. No.10633 of 2019) had been decided by a co‑ordinate bench, ordering payment of dues with interest at 9% per annum. After hearing counsel, the court directed the respondents to examine the petitioner's case in light of those precedents and to issue a final order within eight weeks, indicating any amounts already paid. In the absence of a final determination, the court disposed of the present writ petition, effectively leaving the relief sought pending further administrative action.
Issues considered
- Whether the petitioner is entitled to payment of retiral benefits under the revised pay scales and arrears
- Whether a writ of mandamus can be issued directing the respondents to make such payment
- Whether interest at 9% per annum is applicable from the date of retirement
Subjects
- Retiral benefits
- Mandamus
- Municipal Corporation
