Holding
The Court held that the petition must be disposed pending the respondents’ examination of the claim in accordance with the earlier judgments, and directed them to pass an order within eight weeks.
Summary
The petitioner, a former Assistant Clerk of Nagar Parishad Samastipur, filed a writ petition seeking a mandamus directing the State and Municipal Corporation to pay his retiral benefits, including provident fund, gratuity, leave encashment and pension, calculated on the revised fifth and sixth pay scales with interest. The respondents argued that the service records were missing and therefore the pensionary benefits could not be released, and that no final order had been passed. The petitioner relied on earlier orders of this Court in similar cases where the corporation was directed to pay dues with interest at 9% per annum. The Court examined the submissions and indicated that the matter would be considered in light of the earlier judgments C.W.J.C. No.10632 of 2019 and C.W.J.C. No.10633 of 2019 concerning Ram Sevak Paswan and Lalan Prasad Singh, and ordered the respondents to determine the petitioner’s claim and pass a necessary order within eight weeks. The Court further directed that any amounts already paid be reflected in the final order and consequently disposed of the writ petition pending the respondents’ compliance.
Issues considered
- What entitlement does the petitioner have to retiral benefits under the revised pay scales?
- Whether a writ of mandamus can be issued directing the State and Municipal Corporation to pay the petitioner’s retiral benefits.
- Whether the missing service records preclude the release of pensionary benefits.
- Applicability of earlier judgments (C.W.J.C. No.10632/2019 and C.W.J.C. No.10633/2019) to the present case.
