The Court upheld the compromise order approved by the Sub‑Divisional Officer and directed the bank to disburse the maintenance amount, thereby disposing of the writ petitions.
Summary
The petitioners, Hare Ram and his wife Kanchan Devi, along with their daughter‑in‑law Madhuri Devi, filed two writ petitions challenging the non‑disbursement of maintenance amounts awarded under a compromise order dated 10‑08‑2024. The compromise had been approved by the Sub‑Divisional Officer, Danapur, who is the designated authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, allocating 33% of the quantified amount to Kanchan Devi. The petitioners sought a court order directing Uttarakhand Gramin Bank to release the funds in accordance with the compromise. The Court observed that the compromise had been fully accepted by all parties, including the withdrawal of the daughter‑in‑law’s contest, and that the Sub‑Divisional Officer’s order was final on the merits. Consequently, the Court directed the bank to disburse the amount within six weeks and disposed of both writ petitions. The interlocutory applications, if any, were also deemed disposed.
Issues considered
- Whether the compromise order approved by the Sub‑Divisional Officer under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, is binding and enforceable.
- Whether the court should direct the bank to disburse the maintenance amount as per the compromise.
- Whether the writ petitions seeking enforcement of the compromise should be dismissed.
