The petition is disposed of, with the respondents directed to examine the petitioner’s claim and pass a final order within eight weeks, indicating any amounts already paid.

Summary

Ram Kumar Ojha filed a writ petition seeking a mandamus directing the State of Bihar and Samastipur Municipal Corporation to pay his retiral benefits, including provident fund, gratuity, leave encashment and pension, calculated on the revised pay scales with interest from his retirement date of 31/07/2013. The Corporation contended that records were missing and no final order on his pensionary benefits had been passed. The petitioner relied on earlier orders of this Court directing payment of similar dues with interest. The respondents sought time to examine the case in light of two earlier writs, C.W.J.C. No.10632 of 2019 and C.W.J.C. No.10633 of 2019, and promised to pass a necessary order within eight weeks, indicating any amounts already paid. The Court, after hearing counsel, disposed of the petition, directing the respondents to determine the petitioner’s entitlement and issue a final order within the stipulated period, and to note any amounts already released.

Issues considered

  • Whether the petitioner is entitled to payment of retiral benefits under the revised fifth and sixth pay scales.
  • Whether interest at 9% per annum is payable on the pending retiral dues from the date of retirement.
  • Whether the respondents are obligated to pass a final order determining the amount payable within a specified time.

Subjects

  • retiral benefits
  • mandamus
  • pension
  • provident fund
  • gratuity
  • municipal corporation
  • civil writ jurisdiction
