Patna High Court

Dr. Triveni Nath PandeyversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The court ordered the petitioner to make a fresh representation before the registrar, who must verify the claim and, if justified, pay the arrears within six weeks and consider interest within eight weeks, and disposed the writ petition.

Summary

The petitioner, Dr. Triveni Nath Pandey, sought direction for the respondents to release his salary arrears covering the periods 1 Jan 1996‑Mar 2000 and 1 Apr 2000‑2005, along with interest for delayed payment. He alleged that despite similar cases being resolved in his favour, his arrears remained unpaid without justification. The court noted prior orders in CWJC No.12457/2015 and CWJC No.5540/2020, which had granted arrears to other claimants. Accordingly, the court directed the petitioner to file a fresh representation before the university registrar within four weeks, after which the registrar must verify the claim and, if valid, pay the arrears within six weeks and decide on interest within eight weeks. The writ petition was thereafter disposed.

Issues considered

  • Whether the petitioner is entitled to the arrears of salary for the periods claimed
