Patna High Court

Banti KumarversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The court held that the petitioner must first file a representation before the Director, Secondary Education, and therefore dismissed the writ petition.

Summary

The petitioner, Banti Kumar, a BPSC Teacher (English) in Patna, filed a writ seeking an order directing his transfer within the Patna Municipal Corporation, alleging that his application filed on the e‑Shikshakosh portal (TR‑24222086) had not been considered despite a departmental resolution (Memo No. 1729 dated 07‑10‑2024). The State argued that the petitioner must first make a fresh representation before the Director, Secondary Education as per the same resolution. The High Court held that the petitioner must file the required representation within four weeks, after which the concerned authority must decide the matter within eight weeks. Consequently, the writ petition was disposed without granting the transfer order. The court emphasized the need to exhaust the prescribed administrative remedy before judicial intervention.

Issues considered

  • Whether the petitioner is entitled to a writ directing immediate transfer without first filing a fresh representation before the Director, Secondary Education.
  • Whether the court can bypass the administrative procedure prescribed in Memo No. 1729.
