Holding

The Court ordered the petitioner to appear before the District Magistrate within two weeks and directed the Magistrate to decide the arms licence claim within two months, thereby disposing of the writ.

Summary

The petitioner, Amar Kumar, filed an application in 2018 for an arms licence before the District Magistrate, Saran, and a recommendation was issued in 2019. Despite the registration of Arms License Case No. 48 of 2019, the matter remained pending without a valid reason. The respondents contended that the petitioner was served notice, appeared once, and then remained absent from 18‑11‑2021, causing the delay. The Court condoned the delay in refiling the writ, directed the petitioner to appear before the District Magistrate within two weeks, and ordered the Magistrate to adjudicate the licence claim within two months in accordance with law. The writ application was consequently disposed.

Issues considered

  • Whether the District Magistrate is obligated to grant the arms licence in the absence of petitioner’s appearance.
  • Whether the delay in adjudicating Arms License Case No. 48 of 2019 violates procedural law.
