The petition is disposed by directing the District Magistrate‑Collector to consider the case under Section 64 and refer it to LARRA, Gaya, in line with the Kumar Ohm precedent.

Summary

Shrinath Pal filed a writ petition seeking an order directing the District Magistrate‑Collector of Aurangabad to refer his land‑acquisition matter to the Land Acquisition, Rehabilitation and Resettlement Authority (LARRA), Gaya under Section 64(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and for the authority to dispose of it within the period prescribed in Section 60(4). The petitioner urged the court to follow the reasoning in Kumar Ohm v. State of Bihar (CWJC No. 2743 of 2023), where a similar direction was issued. The State had no objection. The Patna High Court, noting the earlier order, directed the District Magistrate‑Collector to consider the case under Section 64 and refer it to LARRA, thereby disposing of the present petition in the same terms. The order was pronounced by Justice Rajiv Roy.

Issues considered

  • Whether the petitioner’s writ petition should be directed to LARRA under Section 64(1) of the RFCTLARR Act, 2013.
  • Whether the court should follow the precedent set in Kumar Ohm v. State of Bihar regarding referral to LARRA.
