DISPOSED

Holding

The Court ordered the petitioner to file a fresh representation and directed the Registrar of Tilka Manjhi Bhagalpur University to decide the grievance and release admissible salary benefits within a stipulated period, thereby disposing of the writ application.

Summary

The petitioner, Mohammad Alauddin, filed a writ petition seeking the immediate release and payment of his salary arrears covering April 2000 to February 2012. He claimed that a detailed representation he had earlier submitted to the university remained pending without any adjudication. The university argued that the matter should be decided by its own authorities after a fixed timeline. The Court directed the petitioner to file a fresh, detailed representation, referencing the earlier one, within four weeks, and ordered the Registrar of Tilka Manjhi Bhagalpur University to pass a reasoned order and release any admissible salary benefits within six weeks of receiving the representation. Consequently, the writ application was disposed of. The order emphasizes procedural compliance before any monetary relief can be granted.

Issues considered

  • Whether the High Court can compel the university authorities to release the petitioner’s pending salary arrears.
  • Whether the petitioner must file a fresh representation before the university can adjudicate his claim.
