Mostt. Kiran DeviversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The petition is dismissed as the pension has already been sanctioned and paid to the petitioner pursuant to the PPO issued by the Accountant General.

Summary

Kiran Devi, the widow of the late Ashok Kumar, filed a writ petition seeking a family pension from the State of Bihar. The State contended that a sanction order for the pension had already been issued, referencing a PPO dated 15‑12‑2025 that covered the period from 03‑07‑2017 to 28‑08‑2022. The petitioner did not dispute the factual findings presented by the State. The court noted that the factual position was undisputed and that the pension had indeed been sanctioned and paid as per the PPO. Consequently, the court found no ground to interfere with the State's action and disposed of the writ petition. The order was delivered by Justice Ajit Kumar on 10‑04‑2026.

Issues considered

  • What is the entitlement of the petitioner to a family pension under the applicable pension rules?
  • Whether the sanction order and PPO issued by the Accountant General constitute a valid and sufficient basis to deny further relief in the writ petition?
