Summary

Petitioner Rahmati Khatoon filed a writ petition seeking the release of her three-wheeler (Toto) seized by police in connection with the recovery of 77 litres of illicit liquor. The vehicle was seized under Sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Act, 2016 in a case registered against her husband. The State responded that it had no objection and would consider any such application and pass a reasoned order within a stipulated time. The Court granted the petitioner liberty to file the Rule 12A application within four weeks and directed the competent authority to decide it within six weeks, thereby disposing of the writ petition.
