The High Court declined to interfere with the Debt Recovery Appellate Tribunal’s interim order, directing the petitioner to seek relief before the Tribunal.
Summary
M/s Maiya Ji Cold Storage Pvt. Ltd. filed a writ petition in the Patna High Court seeking to vacate an interim order dated 23 March 2026 passed by the Debt Recovery Appellate Tribunal (DRAT), Allahabad, which had stayed the operation of a Debt Recovery Tribunal (DRT) order dated 28 January 2026. The petitioner argued that the DRAT order contravened the SARFAESI Act and a Supreme Court precedent (Optiemus Infracom Ltd. v. Ishan Systems). The High Court observed that the petitioner has an adequate remedy to apply for vacating the stay before the DRAT, which was already listed for hearing on 14 July 2026. Consequently, the Court declined to interfere with the DRAT’s interim order and directed the DRAT to consider any application filed by the petitioner. The writ petition was therefore disposed without any order against the DRAT.
Issues considered
- Whether the High Court can interfere with the interim order of the Debt Recovery Appellate Tribunal under the SARFAESI Act
