Holding
The petition is disposed of, with the Court directing the respondents to determine and pay the petitioner’s retiral dues, including interest, in accordance with earlier orders.
Summary
The petitioner, a former sweeper of Samastipur Municipal Corporation, filed a writ petition seeking a mandamus directing the State and the Corporation to pay all his retiral benefits, including provident fund, gratuity, leave encashment, and revised salary and pension with interest. The respondents argued that the service records were missing and therefore the pensionary benefits could not be released. The petitioner relied on earlier orders of this Court in similar cases where the Corporation was directed to pay dues with interest at 9% per annum. The Court examined the submissions and noted that if any amounts had already been paid, they would be reflected in the final order. Consequently, the Court disposed of the petition, directing the Executive Officer or competent municipal authorities to determine and pay the petitioner’s dues, referencing the earlier orders for guidance.
Issues considered
- Whether the petitioner is entitled to payment of all retiral benefits under the revised pay scales and applicable statutes.
- Whether a writ of mandamus can be issued directing the State and Municipal Corporation to release the pending pensionary benefits.
- Whether interest at the rate of 9% per annum is applicable from the date of retirement to actual payment.
