Patna High Court

Umesh SinghversusSmt. Gunja Devi

Decided
Disposal
DISMISS FOR NON-PROSECUTION

Holding

The appeal is dismissed for non‑prosecution due to the appellants' failure to comply with the court's orders.

Summary

Umesh Singh and Dinesh Singh filed a first appeal (No.67 of 2022) before the Patna High Court against six respondents. No counsel appeared for either side, and the parties remained absent throughout the proceedings. The court had earlier, on 6 February 2026, granted the appellants six weeks to comply with an order dated 24 November 2025, which they failed to do. A further extension of one month was given on 23 March 2026, but the appellants still did not comply. Observing that the appellants had lost interest in pursuing the matter, the court dismissed the appeal for non‑prosecution, concluding that the failure to comply with procedural orders warranted dismissal.
