Decided
Disposal
D.F.D. FOR NON APPEARANCE

Holding

The second appeal is dismissed for default under Order XLI Rule 17 of the Code of Civil Procedure.

Summary

The Patna High Court considered three second appeals (Nos. 165, 166 and 167 of 1992) filed by various widows, sons and wives concerning a dispute in Rohtas district. On several dates (04‑09‑2025, 11‑09‑2025, 09‑10‑2025, 13‑10‑2025 and 06‑01‑2026) no counsel appeared on behalf of the appellants. The court examined the record and noted the continuous absence of the appellants despite repeated notices. Applying Order XLI Rule 17 of the Code of Civil Procedure, the court held that the appeal could be dismissed for default. Consequently, the second appeals were dismissed for default. The order was pronounced by Justice Ramesh Chand Malviya.
