Summary
The State of Gujarat filed Criminal Appeal No.1661 of 2005 before the Gujarat High Court challenging the conviction of Vallabh @ Tetto Ramjibhai Parmar. The appellant sought to uphold the conviction. During the hearing, the police submitted a report confirming that the sole accused had died on 10 June 2016. The court considered whether the death of the accused barred continuation of the appeal. Relying on the principle that criminal proceedings cannot proceed against a deceased person, the court held that the appeal stood abated. Accordingly, the appeal was disposed of without further hearing.
