Holding
The appeal must be transferred to the Sessions Court as it falls under the proviso of Section 372 of the Code of Criminal Procedure and Section 413 of the BNSS.
Summary
The complainant appealed an acquittal of the accused under Section 138 of the Negotiable Instruments Act, filing the appeal under Section 378 of the Code of Criminal Procedure and Section 419 of the Bharatiya Nagrik Suraksha Sanhita. The High Court, referencing its recent decision in Shivsinh Ganpatsinh Solanki v. State of Gujarat, held that a victim‑complainant has a specific right to appeal under the proviso of Section 372 of the Code and Section 413 of the BNSS to the Sessions Court. Consequently, the Court declined to consider the merits and ordered the appeal to be transferred to the appropriate Sessions Court, directing the Registry to send the complete record. The order emphasized the need for the lower appellate court to dispose of the matter expeditiously. No substantive merits of the original acquittal were examined.
Issues considered
- The jurisdiction of the High Court to entertain an appeal under Section 378 CrPC against an acquittal in a Section 138 NI Act case.
- Whether the complainant, as victim, must file the appeal under the proviso of Section 372 CrPC/Section 413 BNSS before the Sessions Court.
