The application for temporary bail is rejected.
Summary
The applicant, Shivanand Vishnupasad Rampyare Pand... (Rubi Shivananand Pand...), filed a criminal miscellaneous application seeking temporary bail for 30 days on the ground of making financial arrangements. The applicant failed to appear when called out. The Additional Public Prosecutor highlighted that the applicant had previously absconded for 330 days after being released on temporary bail on 26-08-2022. Considering these jail remarks, the Court examined whether it should exercise its discretion to grant bail. The Court concluded that the applicant’s conduct demonstrated a risk of non‑appearance and therefore declined to grant bail. Consequently, the application for temporary bail was rejected.
Issues considered
- Whether the Court should grant temporary bail to the applicant in view of his prior absconding.
