ARUN ALIAS KANCHO DINESHBHAI PRAJAPATIversusSTATE OF GUJARAT

Disposal
28-REJECTED @ ADM.STAGE

Holding

The court refused to grant temporary bail, rejecting the application.

Summary

The applicant, Arun alias Kancho Dineshbhai Prajapati, filed a criminal miscellaneous application seeking temporary bail. The jail records revealed that the applicant had previously been released on temporary bail but subsequently absconded for 755 days before being re‑apprehended, and his conduct in jail was reported as poor. No justifiable ground for further temporary bail was presented. The court examined these facts and exercised its discretion, concluding that the applicant’s prior absconding and misconduct outweighed any reason to grant bail. Consequently, the application for temporary bail was rejected. The order was directed to be communicated to the jail authority.
