High Court of Gujarat

ABHISHEK ALIAS KADU ALIAS FEKLA AMBESHKUMAR PITAMBAR CHAUHANversusSTATE OF GUJARAT

Disposal
28-REJECTED @ ADM.STAGE

Holding

The court denied temporary bail, holding that the petitioner’s conduct and absconding preclude the grant of bail.

Summary

The petitioner, Abhishek alias Kadu alias Fekla Ambeshkumar Pitambar Chauhan, filed a temporary bail application through jail. The court noted that the petitioner had been released on 27 June 2025 for a brief period (2-10 July 2025) and subsequently absconded for 124 days before being re‑arrested. The jail report highlighted poor conduct and the absence of any justifiable reason for bail. Considering these circumstances, the court found no sufficient ground to grant bail. Consequently, the application for temporary bail was rejected and the order was directed to the jail authority.

Issues considered

  • Whether the petitioner is entitled to temporary bail despite having absconded for 124 days after a prior release.
