- 38-RULE ABSOLUTE/ALLOWED @ FH
- Bench
- P M RAVAL
Holding
The court exercised its discretion to grant temporary bail because the applicant's financial and medical circumstances justified relief.
Summary
The applicant, Shankar Ramjibhai Pinglasur, filed a criminal miscellaneous application seeking temporary bail for 30 days on the grounds of needing financial assistance for his family and medical treatment for his mother. The respondent State of Gujarat waived service of notice of rule. The court examined the applicant's averments and noted jail remarks indicating the applicant had never been released. Exercising its discretion, the court found the applicant's circumstances sufficient to merit temporary relief. Consequently, the court granted temporary bail for 10 days upon furnishing a personal bond of Rs.10,000 and required the applicant to appear before the nearest police station thrice during that period, with a condition to surrender after the bail expires.
Issues considered
- Whether the applicant is entitled to temporary bail on the basis of financial and medical grounds despite the jail's observation that he has never been released
